Employee versus independent contractor…contrary to popular belief, it takes more than a 1099 tax form for someone to be properly classified as an independent contractor.  Misclassifying someone as an independent contractor can have dire consequences when it comes to noncompliance with state tax, wage and hour, workers compensation and unemployment compensation laws.  And while agencies such as the United States Department of Labor are ratcheting up enforcement in this area through pro-active audit initiatives, individuals can seek their own recourse as well. 

Unfortunately, not all of these subjects operate with the same definitions; leaving companies without a clear roadmap as to how to properly handle their people.  Ensure that you are classifying your personnel properly as you learn the factors for properly classifying your people; identify common pitfalls and mistakes to avoid and learn to manage misclassification situations that may have occurred to minimize liability.
