Absence from work causes lost productivity, added operating costs and even poor employee morale. Confronted with these financial and operational pressures, it is very tempting to take aggressive disciplinary action or even terminate the absent worker. As tempting as this may be, mismanaging absent employees who are ill or injured can lead to additional costs and potential liability as a number of laws including (but not limited to) the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA) and potentially state Workers Compensation laws should be included in your decision making process. This program will provide a road map to help guide employers through the intricate compliance issues involved in managing employees with a medical condition.

 

TARGET AUDIENCE
Human Resource professionals, managers and specialists who have some knowledge in these areas.

LEARNING OBJECTIVE
Participants will gain an understanding of:

• When is each law triggered?
• What if more than one law applies?
• Obtaining medical information
• Managing attendance issues
• When can employment be terminated?
• Compensation issues
• Benefit coverage and continuation
• Return to work and light duty issues

Note: This program is based on a working knowledge of the three legal statutes, it is highly recommended that attendees have prior training and/or practical experience on the Americans with Disabilities Act, Family and Medical Leave Act, and Workers’ Compensation Basics prior to enrolling.
