Topic:  EEOC’s Proposed Guidance on Harassment in the Workplace and Why Should You Care

For many employers, the subject of harassment and discrimination is often a topic in which they are concerned about how a state enforcement agency may handle those matters.

After all, most cases are resolved there.  However, the Equal Employment Opportunity Commission (EEOC) remains a player when it comes to how Title VII federal discrimination cases should handle and also how that law should be interpreted (which can have a cascading effect downward to states who are empowered to handle those matters too).  With the publication of new proposed enforcement guidance, the EEOC has clarified its positions on numerous issues such as what constitutes various forms of unlawful harassment, what is involved to be able to establish a case of harassment, liability, and more.  So, what’s in the guidance?  How should you care?  How could it affect your business?
